Terms & Conditions Pacific Web

Pacificweb Internet Services, Inc. (hereinafter referred to as “PACIFICWEB”) provisioning of a fiber internet service (hereinafter referred to as the “Service”) shall be governed by the following terms and conditions (hereinafter referred to as the “Agreement”):

1. SERVICES PROVIDED

1.1 — PACIFICWEB agrees to provide internet access services to Subscriber as described in the selected plan (the “Service”). The service includes the provision of internet connectivity, network equipment, and related technical support, as applicable.
1.2 — The subscriber acknowledges that PACIFICWEB retains all rights, title, and interest in the Service, including any software, equipment, or intellectual property associated with it.

2. TERM

2.1 — This agreement shall commence on the effective date, as defined below, and shall be valid for the duration of the lock-in period of 12 months, 24 months, 36 months starting from ____________. Following the initial term, this agreement will automatically renew for subsequent terms of the same duration unless terminated by either party in accordance with the termination section below.

3. FEES AND PAYMENT

3.1 — The subscriber agrees to pay PACIFICWEB the fees associated with the selected plan as outlined in PACIFICWEB’s pricing schedule, which may be subject to change with prior notice. The fees may include a one-time installation fee, monthly service charges, equipment charges, and any applicable taxes.
3.2 — Payment for the service shall be made in advance on a monthly basis, as specified in the invoice provided by PACIFICWEB. The subscriber shall make payment by the due date stated on the invoice.
3.3 — In the event of late payment, PACIFICWEB reserves the right to suspend the service until payment is received on the first month the subscription fee is unpaid. Additionally, the subscriber will incur additional charge of three percent (3%) of the subscription fee for every month the service remains unpaid.

4. SERVICE LEVEL AND TECHNICAL SUPPORT

4.1 — PACIFICWEB shall make reasonable efforts to provide a reliable and uninterrupted internet service. However, the subscriber acknowledges that occasional service disruptions, maintenance activities, or factors beyond PACIFICWEB’s control may result in temporary unavailability or degradation of the service.
4.2 — PACIFICWEB shall provide technical support during regular business hours for issues related to the service. The subscriber may contact PACIFICWEB’s support team via the designated communication channels for assistance.
4.3 — PACIFICWEB reserves the right to suspend or terminate the service in the event of any violation of the terms of this agreement by the subscriber, including but not limited to unauthorized use, excessive bandwidth consumption, or violation of applicable laws and regulations.

5. SUBSCRIBER RESPONSIBILITIES

5.1 — The subscriber agrees to use the service in accordance with all applicable laws and regulations. The subscriber shall not use the service for any illegal, unethical, or unauthorized activities, including but not limited to the transmission of copyrighted material, spamming, hacking, or any activity that may interfere with PACIFICWEB’s network or other user’s access to the service.
5.2 — The Subscriber shall not modify, reverse engineer, or tamper with any equipment or software provided by PACIFICWEB without prior written consent. The subscriber shall not attempt to access restricted areas of PACIFICWEB’s network or interfere with the operation of the service.

6. LIMITATION OF LIABILITY

6.1 — PACIFICWEB shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of or inability to use the service, including but not limited to loss of data, profits, or business opportunities.
6.2 — PACIFICWEB’s liability under this agreement, whether in contract, tort, or otherwise, shall be limited to the fees paid by the subscriber for the affected service during the three (3) months preceding the event giving rise to the liability.

7. CONFIDENTIALITY

7.1 — The parties agree to keep confidential all non-public information disclosed by one party to the other during the term of this agreement, including but not limited to technical, financial, and business information.
7.2 — The parties shall use the confidential information solely for the purpose of fulfilling their obligations under this agreement and shall not disclose or make the confidential information available to any third party without prior written consent of the disclosing party.

8. PRIVACY POLICY

PACIFICWEB shall process and handle any personal data of the subscriber in accordance with its Privacy Policy, which is available on PACIFICWEB’s website. By using the service, the subscriber agrees to the terms of the Privacy Policy.

9. DISCONNECTION

9.1 — The subscriber agrees that PACIFICWEB may, without prior notice, disconnect the service of any subscriber whose bill remains unpaid after the specified due date. Subscriber also agrees that PACIFICWEB may temporarily suspend the service in any of the following instances:
- 9.1.1 Violation by subscriber of the terms and conditions of this agreement;
- 9.1.2 Failure to pay the subscription fee for three (3) consecutive months;
- 9.1.3 Misrepresentation or false statement by subscriber in the application for service;
- 9.1.4 Illegal connection or use of unauthorized equipment or accessories;
- 9.1.5 Suspicious fraudulent misuse or abuse of service, ONU and/or Peripherals;
- 9.1.6 Unauthorized transfer of service/location;
- 9.1.7 Failure to notify PACIFICWEB of change in billing address;
- 9.1.8 Another analogous cause, in case the connection leads to eventual termination, pre-termination charges shall be computed starting from the date of the disconnection and not of the termination.
- 9.1.9 Disconnection shall become permanent upon failure of subscriber to resolve the ground for discontinuance of service within thirty (30) days starting from the date the service was disconnected.

10. TERMINATION

10.1 — The subscriber may terminate this agreement with written notice to PACIFICWEB, providing a reasonable period for the other party to remedy any breach of the agreement. In the event of a material breach that remains unremedied, this agreement may be terminated immediately.
10.2 — PACIFICWEB may immediately terminate this agreement in the event of subscriber failure to resolve the settlement of their dues within 30 days from the disconnection of the service.
10.3 — In case the subscriber terminates the service prior to the expiration of the lock-in period, they shall be billed for the full amount of the remaining months.
10.4 — The subscriber agrees that the pre-termination prior to the expiration of the lock-in period entails the forfeiture of the deposit and the settlement of all outstanding obligations, fines, and fees for each unexpired month of the lock-in period. (Example: Monthly Subscription Fee x Remaining Months of Lock-in Period + Additional Charges)

11. GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

12. ENTIRE AGREEMENT

This agreement constitutes the entire agreement between PACIFICWEB and the subscriber, superseding any prior agreements, understandings, or representations, whether written or oral. Any modifications to this agreement must be made in writing and signed by both parties. IN WITNESS WHEREOF, the parties here to have executed this service agreement as of the effective date.
